HB 4477 Summary

• Amends Michigan sentencing guidelines (MCL 777.16g) to add two new felonies to the sentencing grid: institutional desecration and causing vulnerable adults to provide sexually explicit visual material.

• Establishes sentencing classifications for institutional desecration offenses involving $20,000 or more (Class D, 10-year maximum) and offenses involving $1,000-$20,000 (Class E, 5-year maximum).

• Classifies causing vulnerable adults to provide sexually explicit visual material as a second or subsequent offense as Class E felony with 5-year maximum sentence.

• Takes effect February 13, 2024, contingent upon enactment of House Bills 4320 and 4476 in the 102nd Legislature.

• Approved by Governor on December 7, 2023.
