HB 5126 Summary

• Amends sentencing guidelines in Michigan's Code of Criminal Procedure to add new offense categories for heroin, fentanyl, and carfentanil delivery and manufacturing.

• Creates Class A felony for delivery or manufacture of 1,000 or more grams of heroin, fentanyl, carfentanil, or certain opiates with a life sentence maximum.

• Establishes graduated penalties ranging from Class A to Class D felonies for amounts of 450 grams or more down to less than 50 grams of heroin, fentanyl, carfentanil, or certain opiates, with maximum sentences from 30 years down to 10 years.

• Removes previous sentencing guidelines for large-quantity Schedule 1 and 2 controlled substances (1,000+ grams, 450-1,000 grams, and 50-450 grams) and replaces them with opioid-specific provisions.

• Takes effect 90 days after enactment and is contingent on passage of HB 5124 (request no. 04127'23).
