Allows courts to sentence defendants to probation for violations of the public health code involving controlled substances, excluding heroin, fentanyl, carfentanil, and their derivatives.

Changes gender-neutral language in probation statute by replacing "his or her" with "the defendant's" and "person" with "individual" throughout the section.

Maintains existing probation eligibility restrictions that exclude murder, treason, criminal sexual conduct in the first or third degree, armed robbery, and major controlled substance offenses.

Takes effect 90 days after enactment, contingent upon passage of Senate Bill No. ____ or House Bill No. 5128.
