Changes the department name from "Department of Community Health" to "Department of Health and Human Services" throughout the statute.

Adds definitions for "health data utility" (a system operated by health information exchange that combines and facilitates exchange of clinical and health data for treatment, care coordination, and public health purposes) and "health information exchange" (nonprofit entity operating inclusive health information technology infrastructure).

Requires issuance of a request for proposal by March 1, 2025 to select a health information exchange to operate a health data utility in Michigan, with compliance to all federal and state cybersecurity and data protection laws.

Establishes minimum requirements for selected health information exchange including real-time data routing, public health program access, HITRUST certification or equivalent, nonprofit status, significant provider/agency connections, and advanced identity management and patient consent management capabilities.

Provides patients the ability to opt out of data sharing through the health data utility at any time through a clear and conspicuous process.
