Amends the Identity Theft Protection Act definition of "agency" to clarify that the term includes institutions of higher education in Michigan.

Revises the definition of "breach of the security of a database" to specify that unauthorized access by employees does not constitute a breach if the access was in good faith, related to agency activities, and did not involve misuse or unauthorized disclosure of personal information.

Restructures the definition of "financial institution" to use a numbered list format and updates references to the motor vehicle sales finance act from MCL 492.101 to 492.141 to MCL 492.101 to 492.137a.

Makes technical corrections throughout the statute including capitalization changes (e.g., "social security" to "Social Security," "x-rays" to "X-rays") and clarifies references to the Michigan consumer protection act (changing citation from 1971 PA 331 to 1976 PA 331).

Bill takes effect only if Senate Bill No. ____ or House Bill No. 5354 is enacted into law.
