Department must develop a prospective payment system under the medical assistance program to fund certified community behavioral health clinics in compliance with federal law and regulations.

Payment system must comply with all federal methodologies and obtain necessary waivers and approvals from the Centers for Medicare and Medicaid Services, with implementation required before October 1, 2027, subject to approval.

Department shall promulgate policies ensuring licensing compliance, mitigating conflicts of interest between clinics and prepaid inpatient health plans, defining retaliatory actions, and establishing dispute resolution procedures with an independent adjudicator.

Department must establish and enforce penalties for rule violations, including fines, contract suspension, or loss of certification as a certified community behavioral health clinic.

Bill does not take effect unless House Bill No. 5372 of the 102nd Legislature is also enacted into law.
