HB 5411 Summary

• Removes "sodomy" from the list of sexual offenses that may result in closed preliminary examinations and replaces it with "bestiality, sexual contact or sexual penetration upon a human corpse"

• Updates language in MCL 766.9 to replace gendered pronouns ("his or her") with gender-neutral language ("the magistrate's")

• Changes mandatory language from "shall" to "must" in procedures for determining whether to close preliminary examinations to protect victims or witnesses

• Modifies the sentencing guidelines table (MCL 777.16i) to replace the offense description "Sodomy" under MCL 750.158 with "Bestiality or sexual contact or sexual penetration upon a human corpse" while maintaining the same 15-year statutory maximum penalty

• Makes the amendments effective 90 days after enactment, contingent on passage of Senate Bill No. ____ or House Bill No. 5410
