Hospitals and freestanding surgical outpatient facilities must offer patients any unused portion of eye drops or eye ointments dispensed for ophthalmic surgical procedures or medical care if the drug is needed for continued treatment after discharge.

The facility-provided drug must have been ordered by the facility, administered to the patient during inpatient care, and have an unused portion required for the patient's continued treatment.

If a pharmacist dispenses the offered drug instead of a prescriber, the drug must be labeled according to requirements for drugs dispensed by prescribers, and the pharmacist's counseling requirement is waived.

The prescriber of the facility-provided drug must counsel the patient on proper use of the drug.

"Facility-provided drug" is limited to eye drops or eye ointments that are not pharmaceutical compounds prepared under existing law.
