HB 5835 Summary

• Amends MCL 777.13m (sentencing guidelines in the Code of Criminal Procedure) to add xylazine offenses to the felonies enumerated under Chapter 333 of the Michigan Compiled Laws.

• Adds delivery or manufacture of xylazine for illicit use as a Class E felony with a maximum sentence of 5 years under MCL 333.7401(2)(g).

• Adds possession of xylazine for illicit use as a Class E felony with a maximum sentence of 5 years under MCL 333.7403(2)(f).

• Adds fraudulently obtaining xylazine for illicit use as a Class E felony with a maximum sentence of 5 years under MCL 333.7403a(4)(b).

• Adds selling or offering to sell certain objects for the illicit use of xylazine as a Class E felony with a maximum sentence of 5 years under MCL 333.7455(1)(a); does not take effect unless HB 5834 is enacted into law.
