First offense: felony punishable by up to 5 years imprisonment, up to $5,000 fine, or both; second offense: up to 10 years imprisonment, up to $10,000 fine, or both; third or subsequent offense: up to 20 years imprisonment, up to $20,000 fine, or both.

Increases penalties to up to 25 years imprisonment if victim is under 18 or a vulnerable adult and offender is over 18, or if victim suffers serious physical harm, serious mental harm, or death.

Establishes reduced penalties for offenders under 18 years of age: misdemeanor punishable by up to 1 year imprisonment, with potential court-ordered behavioral health counseling.

Defines key terms including "sexually explicit visual material" (photographs or videos depicting nudity, erotic fondling, sexual intercourse, or sadomasochistic abuse) and "serious mental harm" (substantial alteration of mental functioning manifested in visibly demonstrable manner).
