HB 5989 Summary

• Adds Section 4a to the Protecting Local Government Retirement and Benefits Act (2017 PA 202) to allow retirement pension benefits to be paid directly to special needs trusts established under federal law (42 USC 1396p(d)(4)(A) or (C))

• Permits retirants to direct their retirement allowance to be paid to a special needs trust beneficiary, or allows the retirement allowance beneficiary, legal representative, or minor/incapacitated beneficiary to make such direction after the retirant's death

• Applies only to retirement systems that have a retirement pension benefit

• Repeals Section 2 of the 2017 Protecting Local Government Retirement and Benefits Act (MCL 38.2802)
