Creates the state hazard mitigation fund in the state treasury to receive deposits from the disaster and emergency contingency fund and other state or federal sources, with unexpended funds carried forward rather than lapsing to the general fund.

Establishes that the state hazard mitigation fund may be expended only for hazard mitigation programs by the department of state police, with activities requiring evidence they account for future risks and reduce public exposure to hazards.

Directs the director to promulgate administrative rules governing hazard mitigation fund grant applications, including eligibility limited to state agencies, local governments, and federally recognized tribal governments that maintain FEMA-approved local hazard mitigation plans.

Increases disaster and emergency contingency fund assistance grant limits to $1,000,000 for counties and municipalities under 75,000 population and $2,000,000 for those with 75,000 or more population (previously had three-tier system with lower limits).

Replaces mandatory language ("shall") with "must" throughout the statute and takes effect only if Senate Bill No. 1047 of the 102nd Legislature is enacted into law.
