Removes the marihuana exemption from Michigan's drug delivery causing death statute, making marihuana deliveries that result in death prosecutable under the same felony provisions as other Schedule 1 or 2 controlled substances

Maintains the existing felony punishment of imprisonment for life or any term of years for delivering a Schedule 1 or 2 controlled substance that causes death to the recipient or any other person

Takes effect 90 days after enactment into law

Contingent on the enactment of Senate Bill No. ____ or House Bill No. 6241 in the 102nd Legislature
