Prohibits selling or offering for sale objects specifically designed for inhaling nitrous oxide for recreational purposes or drug paraphernalia, if the seller knows the items will be used to inhale nitrous oxide recreationally or to use controlled substances.

Requires the attorney general or prosecuting attorney to provide written notice at least 2 business days before arrest, informing a person they possess material determined to be nitrous oxide inhalation devices or drug paraphernalia and requesting they cease sales.

Compliance with the written notice serves as a complete defense to prosecution under this section, provided the person continues complying.

Takes effect 90 days after enactment on June 10, 2024, contingent upon Senate Bill No. 58 of the 102nd Legislature being enacted into law.
