Expands definition of "health care provider" to include physicians' assistants, nurses, nurse's aides, medical assistants, hospital employees, medical facility employees, and abortion clinic employees under the Born Alive Infant Protection Act.

Requires physicians or other health care providers attending an abortion that results in live birth to provide immediate medical care by taking all medically appropriate and reasonable actions to preserve the newborn's life, inform the mother, and arrange transfer to another physician or emergency services.

Establishes criminal penalties of up to 4 years imprisonment or fines up to $10,000 for physicians or health care providers who purposely, knowingly, or negligently fail to provide required immediate medical care to a live born infant.

Requires live births resulting from abortions to be reported as required under public health code section 2822 and treated as surrendered newborns under the safe delivery of newborns law.

Takes effect 90 days after enactment.
