Public entities cannot contract with asbestos abatement contractors for asbestos abatement projects unless the entity conducts a background investigation of the contractor.

Background investigations must minimally include checking the Michigan Department of Environment, Great Lakes, and Energy's webpage for environmental violation notices and administrative consent orders, and the federal OSHA webpage for asbestos regulation violations.

Public entities cannot contract with asbestos abatement contractors that have received 5 or more environmental violation notices or been subject to administrative consent orders within the preceding 5 years, unless the entity investigates each violation and determines in writing that the contractor can comply with the contract.

Contractors with 5 or more environmental violations within 5 years cannot be hired without the public entity holding a public hearing with at least 30 days' notice for public input.

Asbestos abatement contractors cannot hire other asbestos abatement contractors unless the public entity has conducted a background investigation of the subcontractor using the same process.
