SB 396 Summary

• Modifies the definition of "demote" for teachers to clarify it does not include reductions in personnel such as workweek or workday reductions.

• Protects probationary teachers rated as effective on their most recent year-end performance evaluation from displacement by continuing tenure teachers solely based on tenure status.

• Establishes new probationary period completion requirements: before July 1, 2024, teachers must receive effective or highly effective ratings on 3 most recent evaluations and complete 5 full school years; beginning July 1, 2024, teachers need only 4 full school years if rated effective or highly effective on 3 consecutive evaluations.

• Requires school districts to provide year-end performance evaluations for continuing tenure teachers and mandates individualized development plans for teachers receiving needing-support ratings, with a maximum 180-day improvement period.

• Takes effect July 1, 2024, and is contingent on Senate Bill 395 being enacted into law.
