Allows cigar bars that failed to file required affidavits for 1-3 years starting in 2023 to regain smoking exemption eligibility for one calendar year if located in cities of 32,000-34,000 population in counties with 100,000-105,000 population.

Exempts the makeup years from the affidavit filing requirement for cigar bars that use the one-year reinstatement provision under subsection (2).

Maintains existing requirements for cigar bar smoking exemptions including 10% minimum income from cigar sales and humidor rentals, physical separation from non-smoking areas, age 21+ entry restrictions, and prohibition of non-cigar tobacco products.

Provides a 21-day grace period for filing overdue affidavits before a cigar bar loses its smoking exemption and must immediately prohibit smoking.

Act takes effect immediately upon approval on December 14, 2023.
