AI Summary

  • Establishes recount procedures limited to determining vote counts for candidates and ballot questions, explicitly prohibiting investigations, audits, or assessments of elector qualifications during recounts.

  • Sets recount filing deadlines of 48 hours after county canvass certification for county-level recounts and 5 p.m. on the second day after state certification for state-level recounts.

  • Creates tiered deposit requirements for recount petitioners ranging from $50 to $500 per precinct based on vote differential margins, with automatic adjustments every 4 years starting January 1, 2027.

  • Requires automatic statewide recounts when elections are certified within 0.1% vote differential for statewide races, 75 votes for state senate races, or 25 votes for state representative races unless the losing candidate opts out within 48 hours.

  • Mandates expedited canvassing schedules when presidential elections have vote differentials under 25,000 votes and authorizes deposit refunds to petitioners only if recounts change election results.
