SB 727 Summary

• Amends Michigan's sentencing guidelines for drug manufacturing and delivery offenses under the Public Health Code (Chapter 333 of MCL)

• Removes previous sentencing categories for delivery/manufacture of 1,000+ grams, 450-999 grams, 50-449 grams, and less than 50 grams of certain Schedule 1 or 2 controlled substances and replaces them with new opioid-specific categories

• Creates new sentencing guidelines for heroin, fentanyl, and carfentanil offenses: 450+ but less than 1,000 grams (40-year maximum), 50-449 grams (30-year maximum), and less than 50 grams (25-year maximum)

• Adds new sentencing categories for certain opiates: 50-449 grams (20-year maximum) and less than 50 grams (20-year maximum), with lower penalties for non-fentanyl Schedule 1 or 2 substances

• Changes sentencing description for counterfeit prescription form possession from MCL 333.7407(1)(g) and relocates it to MCL 333.7407(1)(f), maintaining 4-year maximum penalty; takes effect 90 days after enactment and is contingent on passage of SB 726
