Manufacturers, producers, packers, importers, suppliers, or distributors of consumer products or packaging containing PFAS must provide warning labels or written notices to retail sellers beginning January 1, 2025.

Retail sellers must display PFAS warnings on products if they sell under their own brand, knowingly introduced PFAS, removed existing warnings, received manufacturer notices, or have knowledge the product contains PFAS and no qualifying manufacturer exists.

Required warnings must state the product or packaging includes PFAS and that exposure may have adverse health effects, with additional requirements determined by the Department of Licensing and Regulatory Affairs.

Civil fines escalate based on violation year: $1,000 per day in 2025, $5,000 per day in 2026, and $10,000 per day after 2026, enforceable by county prosecutors or the attorney general.

The Department of Licensing and Regulatory Affairs may promulgate rules to implement the act under the administrative procedures act.
