Department of Education must develop or adopt a model water safety instruction program by December 31, 2024, available to all school districts and public school academies.

Model program must cover flotation devices, water conditions awareness, swim area supervision, safe water behaviors, pool barriers and fencing, formal swim lessons, avoiding alcohol and substance use with water recreation, and CPR for drowning victims.

Department must review and update the water safety model program at least annually.

Beginning in the 2026-2027 school year, all school districts and public school academies must provide age- and grade-appropriate water safety instruction to students as part of health or physical education courses.

Schools may customize water safety instruction based on their geographic characteristics and special circumstances.
