SB 1086 Summary

• Establishes temporary do-not-sell list (180-day duration) and indefinite do-not-sell list for firearms that individuals can voluntarily join by submitting applications to county clerks or law enforcement agencies.

• Requires the Department of State Police to enter names on do-not-sell lists into the National Instant Criminal Background Check System and other federal/state systems within 24 hours and remove them within 24 hours of list removal.

• Allows individuals to remove their name from the temporary list 30 days after adding it or from the indefinite list through court petition within 90 days or by application to county clerk/law enforcement after 90 days.

• Makes it a felony punishable by up to 5 years imprisonment or $1,000 fine for any person to add another individual's name to either do-not-sell list without authorization.

• Requires licensing authorities to check the do-not-sell lists when issuing firearm purchase licenses and prohibits sales to individuals whose names appear on these lists; updates the definition of "firearms records" to include section 12c submissions.
