Creates civil and criminal liability for nonconsensual creation or dissemination of sexually explicit "deep fakes" - realistic AI-generated images, videos, or audio depicting identifiable individuals in intimate situations or sexual acts

Allows depicted individuals to sue for economic and noneconomic damages, profits made from the deep fake, attorney fees, and injunctive relief with civil fines up to $1,000 per day for violating court orders

Establishes misdemeanor penalties of up to 1 year imprisonment and/or $3,000 fine for violations; felony penalties of up to 3 years imprisonment and/or $5,000 fine when the perpetrator profits, posts online, causes financial loss, or acts with intent to harass or extort

Exempts creation or dissemination for criminal investigations, reporting unlawful conduct, medical treatment, legal proceedings, and matters of public interest where the deep fake is clearly identified as such

Shields internet service providers, telecommunications companies, and technology developers from liability for content created by others, provided their technology is not designed or marketed for nonconsensual explicit deep fakes
