Replaces the current single penalty for wage theft fraud (up to $1,000 fine and/or 1 year imprisonment) with a tiered penalty structure based on the value of unpaid wages and fringe benefits

Establishes penalties ranging from misdemeanors for amounts under $1,000 to felonies for larger amounts, with maximum imprisonment of 93 days for theft under $200 up to 20 years for theft of $100,000 or more

Allows fines of up to 3 times the value of the unpaid wages and fringe benefits across all tiers

Increases penalties for repeat offenders, including elevating misdemeanor charges to felony charges for employers with prior convictions under this section

Takes effect 90 days after enactment
