AI Summary

  • Allows property owners to install soft erosion control structures on Great Lakes shorelines (Lake Superior, Michigan, Huron, Erie, and Lake St. Clair) without a permit, provided they file a written notice with the department before installation

  • Restricts above-grade walls to moveable brick, stone, biodegradable materials, or soft permeable synthetic textiles (polypropylene/polyester with no more than 4% carbon black and no BPA)

  • Soft erosion control structures must be constructed using sandbags, sand-filled geotubes, or geotextile tubes made from approved materials and installed according to manufacturer recommendations

  • Structures may remain in place as long as they don't impede shoreline walkability below the ordinary high water mark and remain mostly covered by sand without visible degradation

  • Property owners with an operational septic system within 100 feet of the wave cut may install a hard wall revetment to replace a soft erosion control structure without applying for a permit

  • Requires the department to give deference to landowner rights over public access rights when reviewing permit applications under this part
