Expands chemical testing for drug and alcohol impairment to include "other bodily fluid" (such as oral fluid) in addition to blood, breath, and urine for commercial motor vehicle operators

Defines "other bodily fluid" as any fluid from the human body capable of revealing the presence of controlled substances or their metabolites, including oral fluid

Allows any peace officer to conduct preliminary oral fluid analysis tests, removing the previous requirement that only certified drug recognition experts could perform such tests

Maintains existing license suspension and revocation penalties for commercial drivers who refuse chemical testing, now applying to refusal of any approved testing method including oral fluid tests

Takes effect 90 days after enactment and is contingent on the passage of House Bill No. 4391
