Creates a new diversion pathway allowing defendants charged with misdemeanor offenses to be assessed for assisted outpatient treatment instead of proceeding through standard criminal competency procedures

Allows the prosecuting attorney, defendant, or defense counsel to request a mental health assessment by a physician, psychologist, or qualified health professional at any time before trial

Requires dismissal of the petition if either the prosecutor or defendant objects to the assisted outpatient treatment order at any stage, returning the case to standard competency proceedings

Orders assisted outpatient treatment for up to 180 days, with misdemeanor charges dismissed 90 days after entry of the treatment order (or 180 days for serious misdemeanors)
