Protects health care providers, facilities, and agencies from civil liability, criminal liability, and professional discipline when acting in good faith on health care decisions made by apparent surrogates, patient advocates, or guardians

Shields health care providers who decline to follow a surrogate's decision based on a reasonable belief the person lacked authority to make health care decisions

Grants immunity from liability to individuals serving as patient advocates, guardians, or surrogates for good faith health care decisions

Imposes $1,000 minimum damages (or actual damages if greater) plus attorney fees against health care providers or facilities that intentionally violate surrogate decision-maker provisions

Establishes $2,500 minimum damages (or actual damages if greater) plus attorney fees for anyone who falsifies, forges, conceals, or destroys patient advocate designations, or fraudulently induces changes to advance health care directives

Contingent on enactment of SB ____ or HB 4418 from the 103rd Legislature
