Limits recoupment of overpaid worker's compensation benefits to no more than 1 year before the date an employer or carrier files an application with the agency to recover the overpayment

Restricts when injured employees can be ordered to reimburse overpayments to three specific circumstances: the employee concealed post-injury earnings, the overpayment resulted from mathematical/technological/clerical error, or the overpayment resulted from a coordination error

Caps recoupment for mathematical, technological, or clerical errors at 50% of the employee's weekly benefit amount

Prohibits magistrates from ordering reimbursement if the employer or carrier unreasonably changed its position on whether the employee has a work-related condition or disability

Allows magistrates to waive recoupment entirely if the injured employee proves it would cause undue harm or would not serve the purposes of the Worker's Disability Compensation Act
