MI HB5310

Establishes statewide open enrollment beginning July 1, 2026, allowing students to apply to attend any public school in Michigan regardless of district residence, replacing the current systems under sections 105 and 105c that limit transfers to within the same or contiguous intermediate districts

Prohibits districts from refusing enrollment based on residential address, district of residence, truancy, intellectual/academic ability, disability, religion, race, sex, or athletic ability; districts may only deny applications based on prior suspensions (within 2 years), expulsions, or felony convictions

Requires districts to annually determine and publish by May 1 the number of available seats for nonresident students at each grade level based on maximum school capacity, accept applications year-round, and respond to applications within 30 days

Eliminates the ability of districts to limit the number or percentage of nonresident students enrolled, except based on available seats; prohibits charging tuition to nonresident students

Mandates annual reporting to the State Board of Education on seats available, transfer applications, acceptances, and denials with reasons; parents may appeal denied applications to the State Board; contingent on passage of HB 5311 and HB 5312
