Allows personal services agreements between Medicaid applicants (or their representatives) and household members, family members, relatives, or any other person for caregiving services without triggering divestment penalties

Establishes "qualified personal services agreements" requiring written, signed contracts made before services are rendered, describing service type/frequency/duration, with payment at or below local market rates

Creates "affirmed personal services agreements" allowing oral or partially oral agreements, validated by a statement under penalty of perjury from someone with firsthand knowledge of the agreement terms

Prohibits the Department of Health and Human Services from presuming that services provided by family or household members are gratuitous (given for free)

Covers services including home maintenance, cleaning, meal preparation, shopping, daily living assistance, transportation to medical appointments, financial management, and similar personal care services
