Prohibits the cannabis regulatory agency from issuing new marihuana retailer licenses beginning January 1, 2026 if it would result in more than 1 retailer per 5,000 residents in a municipality

Creates exemptions from the retailer cap for license renewals, license transfers to another person, and applicants in designated "resort districts" that demonstrate tourism-based need

Establishes a resort district designation process requiring municipalities to submit applications with tourism data including visitor numbers, lodging occupancy, seasonal population estimates, and recreational infrastructure

Removes the previous prohibition on rules that establish limits on the number of state licenses that may be granted

Requires the cannabis regulatory agency to consider adequate capital, site plans, demand documentation, and resort district necessity when reviewing exemption applications
