Expands exemptions for wetlands incidentally created by human activity, adding a catch-all provision exempting wetlands created by "any other human activity that was not specifically intended to create wetlands" from regulation under this part.

Places the burden of proof on the Michigan Department of Natural Resources to establish that an incidentally created wetland should be subject to regulation.

Maintains existing permit exemptions for farming, silviculture, ranching, drain maintenance, and construction of farm/forest roads when activities minimize adverse wetland effects.

Preserves exemptions for recreational uses (fishing, hunting, swimming, hiking) and existing agricultural operations including grazing with fencing up to 11 feet in height.

Retains exemptions for utility line installation under 6 inches in diameter using directional drilling and maintenance of public roads, drains, and existing structures built before October 1, 1980.
