Prohibits health care providers from charging facility fees for telemedicine services, professional medical services provided outside a hospital, and most outpatient hospital services, effective January 1, 2027

Allows facility fees only for services provided in a hospital emergency room or for observation services on a hospital's campus

Requires health care providers that charge permitted facility fees to clearly identify the fee on billing statements and inform patients of the fee amount before services are provided

Creates a private right of action allowing patients harmed by violations to sue for damages, with courts required to award reasonable costs and attorney fees to prevailing plaintiffs

Preserves the ability of insurers and health systems to negotiate payment agreements for fees or costs they mutually consider appropriate
