Allows personal services agreements between individuals (or their legal representatives) and household members, family members, or others for care services without triggering Medicaid divestment penalties

Establishes "qualified personal services agreements" requiring written, signed agreements dated before services begin that specify service type, frequency, duration, and payment at or below local market rates

Creates "affirmed personal services agreements" allowing oral or partially oral agreements if supported by a statement affirmed under penalty of perjury or documentary evidence like invoices, service logs, or canceled checks

Prohibits the Department of Health and Human Services from presuming that services provided by family members or household members are gratuitous (unpaid)

Covers services including home maintenance, cleaning, meal preparation, shopping, daily living assistance, transportation to medical appointments, financial management, and similar personal care services
