Defines "failure" of onsite wastewater treatment systems to include sewage discharge to ground surface, backup into structures, discharge into surface water or groundwater, and structural failures of septic tanks

Establishes a public education and training fund through a $5.00 fee added to permit applications, dedicated to public outreach on wastewater systems and training for local health departments and evaluators

Requires property owners to respond to and remedy system failures and nuisance conditions, with local health departments authorized to inspect properties and issue violation notices for non-compliance
