Amends Minnesota Statutes 2008, section 123B.59, subdivision 1 to adjust qualification criteria for the alternative facilities bonding and levy program.

Increases the building square footage threshold from over 1,850,000 square feet to over 1,500,000 square feet, while raising the maximum average age of building space from 15 years to 35 years or older.

Allows limited program participation for school districts with one or more health and safety projects costing $500,000 or more per site and insufficient capital facilities revenue to fund those projects.

Grandfather clause preserves eligibility for school districts that qualified as of July 1, 2007, as long as they continue meeting the student enrollment, health and safety, and ten-year facility plan requirements.

Effective for revenue in fiscal year 2010 and later.
