Jackson County Board of Commissioners may adopt a resolution to make the county auditor-treasurer position appointive rather than elective, notwithstanding Minnesota Statutes section 382.01.

The board must appoint a department head to discharge duties of the auditor-treasurer position, with a county board resolution controlling the office structure.

Person elected to the position at the last general election must serve and perform all required duties until term completion or a vacancy occurs, whichever is earlier.

County board must publish notice of intent to make the office appointive once weekly for two consecutive weeks and allow public comment before formal adoption of the resolution.

Resolution may be implemented without voter approval unless a petition signed by at least 10 percent of registered county voters is filed within 30 days of the second publication, triggering a referendum requiring majority voter approval.
