Commissioner of health, in consultation with the Minnesota Administrative Uniformity Committee, shall develop a uniform formulary exception document allowing health care providers to request exceptions from group purchaser drug formularies using a standard form.

Uniform formulary exception document must be effective January 1, 2011, and accessible by health care providers and accepted and processed by group purchasers electronically through a secure Internet site.

Beginning July 1, 2009, all health care providers must submit requests for formulary exceptions to group purchasers using the uniform formulary exception document, and all group purchasers must accept this document from health care providers.
