Pharmaceutical manufacturers, wholesale drug distributors, and medical device manufacturers must file annual reports with the commissioner of health disclosing all payments, honoraria, reimbursement, or compensation paid to practitioners or sponsors of medical conferences, meetings, or educational programs during the preceding calendar year.

Reports must be standardized, include the nature and value of payments to particular practitioners or sponsors, identify the practitioner or sponsor, and be made publicly available on the department website in an easily accessible and searchable format.

Prohibits pharmaceutical manufacturers, wholesale drug distributors, and medical device manufacturers from offering or giving gifts to practitioners, with limited exceptions for professional samples, unrestricted grants for educational events, reasonable honoraria and expenses for faculty services, research compensation, informational publications, employee salaries, training programs, and patent royalties.

Practitioners receiving compensation must report the source, amount, and nature to the Board of Medical Practice and notify patients of financial relationships before prescribing or recommending medications or devices from that manufacturer or distributor.

Formulary Committee members cannot accept gifts or professional samples from drug manufacturers or wholesale drug distributors and cannot be employed by or agents of such entities.
