Increases the definition of "small employer" from 50 to 75 current employees on business days during the preceding calendar year, with at least two current employees on the first day of the plan year.

Employers with more than 75 employees but 75 or fewer under the federal definition (U.S. Code, title 29, section 1002(6)) are classified as small employers under this subdivision.

Requires the commissioner of commerce, in consultation with the commissioner of health, employers, and health plan companies, to develop and recommend a uniform health coverage application form for small employer market consideration by the 2011 legislature.

Excludes employees covered under collectively bargained trust arrangements or separate health coverage from the small employer employee count determination.

Section 1 effective August 1, 2011; Section 2 effective July 1, 2010.
