Qualified professionals employed by personal care assistance provider agencies must undergo background study per chapter 245C and receive commissioner notice of disqualification status before providing services.

Qualified professionals must develop and monitor care plans, develop monthly service use plans, provide staff training and evaluation, and document all training and communication to improve performance.

Qualified professionals employed by agencies certified for Medicare participation as home health agencies are exempt from training requirements effective January 1, 2010.

Personal care assistance provider agencies must provide documentation at enrollment including contact information, surety bond ($50,000 or 10% of prior year Medicaid payments), fidelity bond ($20,000), workers' compensation insurance, organizational structure, written policies, and certification that 72.5% of revenue funds employee wages and benefits.

Agencies must provide training to personal care assistants working with ventilator-dependent recipients, administered by respiratory therapist, nurse, or physician, with exemption for agencies certified for Medicare participation as home health agencies.
