Amends Minnesota Statutes section 169.06, subdivision 9 to create an affirmative defense for bicyclists and motorcyclists who enter or cross an intersection against a red light.

Affirmative defense requires all four conditions be met: bicycle or motorcycle brought to complete stop, traffic signal showing red for unreasonable time, signal apparently malfunctioning or failed to detect vehicle arrival, and no motor vehicles or persons approaching that constitute immediate hazard.

Defense applies only to red light violations and does not provide protection against other civil or criminal actions.

Effective the day following final enactment, signed into law April 15, 2010.
