HF 2829 Summary

• Modifies discretionary expungement of eviction case court files to require courts find there is a change in circumstances for defendant indicating the eviction case is not a reasonable predictor of future tenant behavior and expungement is in interests of justice.

• Establishes mandatory expungement of eviction cases commenced solely on grounds of contract for deed cancellation or mortgage foreclosure when defendant vacated before action commenced, was tenant during redemption period without notice to vacate, defendant prevailed, parties agreed to expungement, or plaintiff's case lacks basis in fact or law.

• Creates presumption favoring expungement if court has destroyed the eviction case court file.

• Adds personal representative of deceased tenant's estate and personal representative of tenant whose lease may be terminated under section 504B.265 to protections regarding intentional ouster, utility interruption, damages for ouster, and unlawful exclusion or removal.

• Requires courts rule on expungement motions at hearing on eviction following the eviction ruling unless good cause exists to hear later.
