Allows holders of class A, B, C, or D driver's licenses without school bus endorsements to operate type III vehicles if they meet specified conditions including employer status, annual training and certification, background checks, and physical examinations.

Requires annual training and certification covering safe vehicle operation, student behavior including disabilities, orderly conduct, road laws, emergency situations, seat belts, pretrip inspections, safe loading/unloading procedures, and emergency reporting.

Prohibits persons convicted of DUI-related offenses, implied consent law violations, or disqualifying offenses from operating type III vehicles for five years from conviction; prohibits those with three moving violations within three years from operating for one year.

Mandates background checks meeting school district employee, day care employee, or general safety requirements; requires preemployment drug testing; allows employers to use breathalyzers for random or reasonable suspicion alcohol testing.

Effective date July 1, 2010; requires the Commissioner of Public Safety to prescribe rules for type III vehicle driver physical qualifications, which are exempt from chapter 14 and section 14.386 rulemaking requirements.
