• Requires state to conduct background studies on individuals in family child care, adult foster care, and family adult day services licensing programs instead of counties performing studies.

• County agencies may charge background study fees to applicants and license holders not exceeding $100 annually for family child care, with options to reduce or waive fees for financial hardship, provider shortages, new providers, or providers with 16+ hours of training.

• Establishes electronic transmission system for background study information between Department of Human Services, county agencies, private agencies, and license holders.

• Allows licensing reviews for family day child care programs every two years after initial annual review, and for family adult day services programs every two years after initial annual review.

• Implements "rap back system" by January 1, 2011, requiring Department of Public Safety to notify Department of Human Services when new criminal history information is discovered for individuals previously studied.
