Amends Minnesota Statutes 2008, section 116.49, by adding subdivision 5 regarding temporary closure and extension procedures for underground storage tank systems.

Underground storage tank systems must be permanently closed if out of service for five years or more, unless the owner requests an extension from the commissioner.

Commissioner may grant an initial five-year extension if the tank system has remained in compliance with applicable rules during its five-year out-of-service period, followed by one optional additional five-year extension.

Commissioner may revoke any extension if the underground storage tank system is found to be out of compliance with applicable rules.

Underground storage tank systems cannot be returned to service without written commissioner approval based on compliance with applicable rules; if extension is denied, the tank must be removed or filled according to adopted rules.
