HF 3338 Summary

• Amends Minnesota Statutes 2008, sections 16C.04 and 471.87 to modify conflict of interest standards for government contracts.

• Expands the definition of organizational conflicts of interest to include vendors (other than natural persons) making contributions or independent expenditures to support or oppose candidates for state office within 48 months prior to contract award through contract term.

• Requires commissioners to disqualify vendors from contract eligibility or cancel existing contracts for conflicts of interest; permits waiver of requirements only when vital state operations would be jeopardized.

• Allows contract cancellation without penalty if required by the conflict of interest provisions; provides methods to avoid or mitigate conflicts including disqualifying vendors, revising work scope, or allowing vendors to exclude conflicting task areas.

• Effective the day following final enactment for contracts with solicitation documents issued on or after the effective date.
