Commissioner shall review all medical evidence submitted by county agencies and seek additional information from providers, applicants, and enrollees to support disability determinations under Social Security Act rules.

Prior to denying or withdrawing a disability determination request, commissioner must ensure missing evidence is necessary and assist applicants and enrollees in obtaining required evidence, including medical examinations and electronic medical records.

Commissioner shall provide legislative health and human services committees with annual reports by February 1st containing application statistics, average processing times, appeal information, applicant demographics, and credentials of medical review personnel.

Appeals of state medical review team disability determinations must be decided according to established timelines, with written decisions issued within required timeframes or the appeal must be immediately reviewed by the chief appeals referee.
